1. Company Identity
These Terms and Conditions govern your use of the Western Properties Ltd platform available at westernpropertiesltd.co.uk. Western Properties Ltd is a Private Limited Company registered in England and Wales. Company Number: 05885029. Registered Office: Hafan, 5 Kings Road, Radyr, Cardiff, South Glamorgan, CF15 8EB. SIC Code: 68100 – Buying and selling of own real estate. The company was incorporated on 24 July 2006 and remains an active, registered entity.
2. Acceptance of Terms
By accessing or using the Western Properties Ltd platform, you agree to be bound by these Terms and Conditions in full. If you do not accept these terms, you must immediately cease using our platform. Your continued use of the platform constitutes acceptance of any updates to these terms.
3. Platform Purpose
Western Properties Ltd operates a digital real estate marketplace facilitating connections between property owners, buyers and tenants across the United Kingdom. We do not act as an estate agent in the traditional sense but as a technology-enabled marketplace. All property transactions are conducted between the relevant parties, with Western Properties Ltd acting as an intermediary platform.
4. User Accounts & Eligibility
Users must be at least 18 years of age and legally resident or registered in the United Kingdom (or an entity incorporated under UK law) to create an account. You are responsible for maintaining the confidentiality of your account credentials. You must provide accurate, complete and current information during registration. Western Properties Ltd reserves the right to suspend or terminate accounts that violate these terms.
5. Property Listings
All property listings submitted by owners are subject to review and approval by Western Properties Ltd before being published. We reserve the right to refuse, edit or remove any listing that is inaccurate, misleading, fraudulent, or otherwise in violation of these terms or applicable law. Property owners warrant that they have the legal right to list the property and that all provided information is accurate and truthful.
6. Application Fees
Applications to rent or purchase properties listed on our platform require payment of an application processing fee of £35–£50 (as set by the administrator). This fee covers administrative processing costs and is non-refundable except in the circumstances described in our Refund Policy. Payment of the application fee does not guarantee acceptance of your application. Fees are charged in GBP and processed securely via Stripe.
7. Commission Structure
Upon successful completion of a property transaction facilitated through our platform, a commission of £100 total applies: £50 payable by the buyer/tenant and £50 payable by the property owner/landlord. These commissions are due and payable upon exchange of contracts or agreement to let, as applicable. Western Properties Ltd reserves the right to adjust commission rates with 30 days notice.
8. Bidding System
Where a property is listed with bidding enabled, users may place bids on that property. All bids are legally binding offers. By placing a bid, you confirm you have the financial means to complete the transaction at the bid price. The highest bidder at the close of bidding will be contacted to proceed with the transaction. Western Properties Ltd reserves the right to cancel bidding at any time.
9. Messaging & Communications
The platform provides messaging functionality between tenants/buyers and property owners. All communications via the platform may be monitored by Western Properties Ltd for safety, fraud prevention and dispute resolution purposes. Users must not use the messaging system for any illegal, abusive, discriminatory or fraudulent communications.
10. Prohibited Activities
Users may not: list properties they do not own or have authority to list; provide false or misleading information; engage in discrimination on the basis of protected characteristics; attempt to circumvent platform fees by conducting transactions off-platform; use automated systems to scrape or harvest data; engage in any activity that breaches the Equality Act 2010 or any other applicable UK law.
11. Intellectual Property
All content on the Western Properties Ltd platform, including but not limited to design, trademarks, logos and code, is the intellectual property of Western Properties Ltd and may not be reproduced without express written permission.
12. Limitation of Liability
Western Properties Ltd acts as a platform facilitating connections between parties and is not a party to property transactions. To the maximum extent permitted by law, Western Properties Ltd shall not be liable for: loss or damage arising from property transactions; inaccurate information provided by users; service interruptions; or any indirect or consequential losses. Our total liability to you shall not exceed the fees paid by you to us in the preceding 12 months.
13. Dispute Resolution
In the event of a dispute, you should first contact us at support@westernpropertiesltd.co.uk. We will endeavour to resolve disputes within 14 working days. If a dispute cannot be resolved amicably, it shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Data Protection
We process personal data in accordance with UK GDPR and the Data Protection Act 2018. Full details are set out in our Privacy Policy. By using our platform, you consent to the collection and processing of your personal data as described therein.
15. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
16. Changes to Terms
Western Properties Ltd reserves the right to update these Terms and Conditions at any time. Material changes will be notified to registered users by email. Continued use of the platform after notification of changes constitutes acceptance of the revised terms.
